Big Brother: Why Mike Boogie Was Found Guilty Of Stalking Will Kirby

Big Brother season 7 winner Mike "Boogie" Malin was found guilty of stalking his former co-star and housemate Dr. Will Kirby, and was subsequently sentenced to a probation period of two years. Boogie and Will first met on Big Brother season 2, forming the iconic Chilltown alliance that took them far on the series. Theirs was the first-ever true alliance in Big Brother history. Ultimately, Will won Big Brother season 2 and took home the $500,000 grand prize, following one of the most tumultuous seasons ever. As fans watch Big Brother season 26, it's time to revisit this shocking case.

Boogie initially pleaded not guilty to the stalking charges he faced. Then, in November 2020, Boogie was arrested on DUI charges in Las Vegas, which added to his existing legal woes. In April 2021, Boogie appeared in court due to Will's stalking allegations. Boogie was sentenced to a two-year probation period. He was forced to spend three days in an LA County jail – he also had to pay a fine and go to rehab. It's time to talk about what happened before his arrest.

The stalking allegations involving Boogie started in September 2019, when Will, who later appeared on The Traitors, was granted a restraining order against his Chilltown ally and former friend. This was shocking news as Boogie and Will had always been a dynamic duo. As the story goes, Boogie allegedly harassed Will, wanting him to do other reality shows with him as a duo. So, Boogie seemed to be motivated by self-interest. However, Will was more focused on his career as a doctor.

Details regarding the case were appalling. According to Kirby’s court statements, the allegations stemmed from Boogie’s persistent attempts to convince Kirby to join The Amazing Race. Will's rejection seemed to put Boogie into a downward spiral. Things were bad enough that Kirby was forced to press charges.

Boogie had initially pleaded not guilty to the stalking allegations, but later withdrew his plea, choosing “no contest” instead. By changing his plea, he immediately waived his right to trial. As per his "no contest" plea, which denoted guilt, Boogie was required to maintain his approved residence. As well, he had to make his probation officer aware of all of his personal information.

According to the sentencing, after his arrest and release, Boogie also needs to make restitution to Will. Additionally, Boogie must complete 160 hours of community service, and is banned from owning or possessing firearms. Any guns currently in his possession would need to be relinquished as well.

The dermatologist was taken aback by Boogie’s actions, and his fear for his and his family’s safety led him to take legal precautions which seemed to be necessary. Kirby has refrained from sharing any personal details with the public, but his attorney’s comments indicate that the legal action was imperative. Both Kirby and his attorney were happy with the outcome of that case. As per an interview with USWeekly, Kirby's attorney offered:

“On behalf of Dr. Kirby, we are grateful to the criminal justice system for holding Mr. Malin accountable for his actions.”

He goes on to say that there's no shame in seeking legal help, and that Kirby and his family will stay out of the spotlight during this troubling time. Despite the trauma that Boogie put Kirby through, Kirby has yet to make any public statement regarding the specifications of the stalking actions. Kirby was also granted an additional 10-year restraining order that prevents Boogie from nearing Kirby’s family, ensuring their safety for years to come.

After trying their luck on Big Brother 2, Boogie and Will returned to compete with other Big Brother alumni on Big Brother 7: All-Stars. However, this time around, it was Boogie's turn to win the show. These two were incredibly iconic houseguests in the Big Brother universe, and their friendship was often celebrated.

Subsequently, it was shocking to see the charges shared publicly. What was once a seemingly wholesome friendship became incredibly dark. Perhaps the most disturbing thing was the involvement of, and threats to, Kirby's family and young children. This kind of conduct is very disappointing – Boogie crossed a line.

This is an unfortunate ending to what was once such a vibrant friendship between two Big Brother legends. Things got out of control by the time Kirby decided to get a restraining order against Boogie. This results from Boogie's reckless and dangerous behavior towards a person who used to be a close friend.
